Scottish Government Respond to Short-Term Let Regulatory Framework Consultation

The Scottish Government has today announced their proposals for short-term let regulation in Scotland following a statement to parliament from the Minister for Local Government, Housing and Planning, Kevin Stewart.

The Minister announced that the Scottish Government would take action in the following three areas:

  • Establish a licensing scheme for short-term lets in Scotland under the 1982 Civic Government Act Scotland. This will include a mandatory element for all short-term let properties on health and safety requirements but local authorities will have a discretionary power to introduce other conditions to the licensing regime on issues such as anti-social behaviour and littering.
  • Empower local authorities to introduce short-term let control areas to tackle short-term letting “hotspots” (under the 2019 Planning Act).
  • Review the tax treatment of short-term lets. This will complement the approach taken with the forthcoming TVL Bill which will be introduced shortly.

The Scottish Government intend to work with stakeholders on the detail of their proposals with the aim of introducing the necessary Statutory Instruments in time for them to come into force by Spring 2021. The ASSC is obviously concerned that the Scottish Government have decided to opt for a licensing regime which we believe is onerous and disproportionate in nature and will entail serious consequences for our hardworking and responsible members, as well as the wider tourist economy in Scotland.

The precise details of the proposals have yet to be released and we will be seeking clarification and further detail from the Scottish Government on what has been unveiled. As ever, we will keep you informed of all the developments as they unfold and issue guidance as necessary.
