PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE

This terms of use document together with the documents referred to in it (‘Terms of Use’), set down the terms of use on for the websites currently www.assc.co.uk and www.embracescotland.co.uk, each a ‘Site’ and together the ‘Sites’, and any additional sites added by The Association of Scotland’s Self-Caterers Limited always excluding third party web sites which anyone accessing the Sites may be signposted or linked to.  Use of a third party site is regulated by the terms and conditions of the owner or operator of that site.  The Terms of Use applies to all site users whether accessing the Sites as a guest, being someone viewing the site, or a registered user, being someone with a log in to give access to areas of the site a guest cannot access, each a ‘User’ and collectively ‘Users’. Use of the Sites includes accessing, browsing, logging in, viewing content and/or registering to use the Sites.

It is important Users read these Terms of Use carefully before starting to use the Sites as these will apply to Users’ use of the Site. By using the Sites, Users confirm that they accept the Terms of Use and to comply with them.

If Users do not agree to the Terms of Use, they should not use the Sites.

Information about The Association of Scotland’s Self-Caterers

This a site operated by a limited company which is The Association of Scotland’s Self-Caterers Limited, company number SC548738 and have its registered office at 227 West George Street, Glasgow, Scotland, G2 2ND (the ‘ASSC’).

Other applicable terms

The Terms of Use refer to the following additional documents and information, which also apply to use of the Sites:

The ASSC has a Privacy Policy which sets out the terms on which it processes any personal data collected from, or provided by, Users and other individuals, members of the ASSC and similar interactions. This is for data the ASSC collect from or that is provided to it. By using the Sites Users consent to such processing and Users warrant that all data provided by them is accurate.

The ASSC also has an Acceptable Use Policy, which sets out the permitted uses and prohibited uses of the Sites. When using the Sites, Users must comply with the Acceptable Use Policy.

The ASSC also has a Cookie Policy, which sets out information about the cookies on the Sites.

All of these policies are available on the ASSC website or may be able to be sent to Users in different formats of requested.

Changes to the Terms of Use

The ASSC may revise the Terms of Use at any time and Users should check these and the associated policies every time they use the Sites.  Any changes made are applicable to User’s access of the ASSC website from the date they are made and will not be intimated specifically.  It is therefore the obligation of User to satisfy themselves as to the content of the Terms of Use and the associated terms and policies when proceeding to use, or while using, the site at any time.

Changes to the Sites

The ASSC may update the Sites from time to time, and may change the content at any time. Any of the content on the Sites may be out of date at any given time and the ASSC is under no obligation to update it.  Before relying on any content, information or details on the Sites, Users should check the accuracy of that content, information, content and/or details to establish its accuracy.  The ASSC will not be responsible for any loss or damage, whatsoever and howsoever incurred, as a result of a User relying on content, information, content and/or details on the Sites without checking or reviewing that content, information, content and/or details first with a third party or another source.

The ASSC gives no warranty not undertaking that the Sites are accurate nor that they can be reeled upon. Some of the information on the Sites may be opinion and not based on fact.

Accessing the Sites

The Sites are available free of charge but Users may require to become members of the ASSC before they are given log in details to access certain secure and/or restricted areas of the Sites.

The ASSC gives no warranty nor undertaking that the Site, nor any content on them, will always be available or be uninterrupted. Access to the Sites is permitted when the Sites are available and the ASSC may suspend, withdraw, discontinue or change all or any part of the Sites without notice. The ASSC will not be liable for any inconvenience, loss or damage, that being whatsoever and howsoever incurred, as a result of the Sites being unavailable at any time or for any period.

Users are responsible for making all arrangements necessary to have access to the Sites.

The Sites are directed to people residing in the United Kingdom. The ASSC does not represent that content available on or through The Sites is appropriate or available in other locations. The ASSC may limit the availability of The Sites or any service or product described on The Sites to any person or geographic area at any time. If Users choose to access The Sites from outside the United Kingdom, Users do so at their own risk.

Account and password

If Users choose to do so, they can be provided with a user identification code, password or any other piece of information as part of the ASSC’s security procedures, Users must treat such information as confidential and must not disclose it to any third party.

The ASSC have the right to disable any Users’ identification code or password, whether chosen by the User or allocated by the ASSC, at any time, if in its reasonable opinion the User has failed to comply with any of the provisions of these Terms of Use.

If a User knows or suspects that another user or third party knows their user identification code or password, you must promptly change these and notify any actual, suspected or anticipated security breach to the ASSC at membership@assc.co.uk.

Payments

By providing your card information, you allow ASSC to charge your card for future payments

Intellectual property rights

The ASSC, or its nominee, is the owner or the licensee of all intellectual property rights on the Sites, and in the material published on it.  Those works are protected by local, EU and global copyright laws, regulations, policies and guidance and all such rights are reserved.

Users must not modify any paper or digital copies of any materials  printed off, downloaded or otherwise captured from the Sites in any way, and must not use any illustrations, photographs, video or audio sequences or any graphics separately from any text on the Sites.

The ASSC’s status (and that of any identified contributors) as the authors of content on the Sites must always be acknowledged.

Users must not use any part of the content on the Sites for commercial purposes without obtaining a licence to do so from the ASSC or our licensors.

If content is printed, downloaded or captured from the site by Users, in beach of these terms of use, the Users’ right to access and /or use the Sites will cease immediately and Users must, without notice, return or destroy any physical or electronic copies of the materials made, and procure any third party passed or given access to such materials also destroys these.

No reliance on information

The content on the Sites is provided for general information only. It is not intended to amount to advice on which Users should rely. Users must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the Sites. Some of the information on the Sites may be opinion and not based in fact.

Although the ASSC makes reasonable efforts to update the information on the Sites, they make no representations, warranties nor guarantees, whether express or implied, that the content on the Sites is accurate, complete nor up-to-date.

Limitation of the ASSC’s liability

Nothing in these Terms of Use excludes or limits the ASSC’s liability for death or personal injury arising from its negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by Scottish law.

To the extent permitted by law, the ASSC excludes all conditions, warranties, representations or other terms which may apply to the Sites or any content on it, whether express or implied and will not be liable to any Users for any loss or damage, including but not limited to: whether in contract, delict (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with the sue of the Sites or use or reliance on anything displayed on, or referred to in, the Sites.

If you are a business user, please note that in particular, the ASSC will not be liable for any inconvenience, loss or damage, whatsoever and howsoever incurred, including but not limited to: loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.

The ASSC will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect a Users’ computer equipment, electronic equipment,  programs, data, software or other proprietary material due to your use of the Sites or to Users downloading of any content on them, or on any website linked or signposted to them.

We assume no responsibility for the content of websites linked on our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

Uploading content to the Sites

Whenever a User make use of a feature that allows them to upload content to the Sites, or to make contact with other users of the Sites, Users must comply with the content standards set out in the Acceptable Use Policy.

Users warrant that any such contribution comply with those standards, and Users will be liable to the ASSC and will indemnify the ASSC for any breach of that warranty.

Any content Users upload to the Sites will be considered non-confidential and non-proprietary. Users retain ownership rights in their content, but Users are required to grant the ASSC and all Users of the site a limited licence to use, store and copy that content and to distribute and make it available to third parties, the grant of which licence is implied and not specific when any such content tis uploaded. The rights Users licence to the ASSC are described in the next in the Terms of Use.

The ASSC can disclose the identity of a User to a third party where that is necessary to meet its obligations, which shall be at the sole discretion of the ASSC,  where that User, in the view of the ASSC, at its sole discretion,  posted or uploaded content to the Sites which constitutes a violation of intellectual property rights and/or of  any right to privacy of the ASSC, or associated third party’s to it,

The ASSC will not be responsible, or liable to any User and/or third party, for the content or accuracy of any content posted by any other User  or third party on the Sites.

The ASSC has the right to remove any posting Users make on the Sites if, in its opinion, and at its sole discretion, that information or post does not comply with the content standards set out in the Acceptable Use Policy.

The views expressed by other Users on V do not represent the ASSC’s views or values. Any information or posts which \users feel do not represent he ASSC;s values should be brought to the attention of the ASSC

Users are solely responsible for securing and backing posts and/or content uploaded to the Sites.

Rights licensed by Users

When Users upload or post content to the Sites they grant the following licences, which grant is implied and not required to be in writing or formalised otherwise, namely: a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform that content in connection with the services provided by the Sites and across different media and to promote the Sites or the ASSC’s services; or that of its partners or associated businesses and their sites; a worldwide, non-exclusive, royalty-free, transferable licence to allow third parties to use the content for their purposes.

The ASSC will only use Users’ materials to carry out Users’ instructions to the ASSC, whether express or implied,  unless in other exceptional circumstances, such as but not limited to a court or other regulator orders us to disclose them, all of which is at the ASSC’s sole discretion.

Viruses

The ASSC does not guarantee the Sites will be secure nor free from bugs nor viruses.

Users are responsible for configuring their own information technology, computer programmes and platform in order to access the Sites. Users may wish to use virus protection software.

Users and/or third parties must not misuse the Sites by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. Users and/or third parties must not attempt to gain unauthorised access to the Sites, the server on which the Sites are stored or any server, computer or database connected to the Sites. Users and/or third parties must not attack the Sites in any way and including but not limited to via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, Users would commit a criminal offence under the Computer Misuse legislation the ASSC reserve the right to report any such anticipated, perceived or actual breach to the relevant  authorities and to co-operate with those authorities by disclosing Users’ identities to them, all at the ASSC’s sole discretion. In the event of such a breach, the Users’ rights to use the Sites are immediately terminated.

Linking to the Sites

Users may link to the SSC home page, provided they do so in a way that is fair and legal and does not damage the ASSC’s reputation or take advantage of it, all at the ASSC’s sole discretion.

Users must not establish a link in such a way as to suggest any form of association, approval or endorsement on the ASSC’s part where none exists.  The existence of such a link shall be at the sole discretion of, and interpreted by, the ASSC.

Users must not establish a link to the Sites in any website that is not owned by the User.

The Sites must not be framed on any other site, nor may Users nor third parties create a link to any part of the Sites other than the home page.

The ASSC reserves the right to withdraw linking permission without notice.

The website to which any User is linking must comply in all respects with the content standards set out in the Acceptable Use Policy.

Where the Sites contains links to other sites and resources provided by third parties, these links are provided for your information only.

The ASSC has no control over the contents of third party sites nor third party resources not the voracity, accuracy nor security of them.

Applicable law

The Terms of Use and all associated polices and information is regulated by the laws of Scotland and the Scottish court have exclusive jurisdiction, unless the ASSC agrees specifically and in writing otherwise.
