ASSC Writes to Local Authorities Highlighting Legal Deficiencies

ASSC has written to several local authorities highlighting a range of legal deficiencies in relation to their short-term let licensing and planning policies, with proposed applications for Judicial Review.

These concerns arose in light of the decision of Lord Braid in the petition for Judicial Review of the City of Edinburg Council Short Terms Lets Licensing Policy (case reference: [2023] CSOH 35) (the “Decision”) and in terms of provisions contained in the The Provision of Services Regulations 2009 (the “2009 Regulations”).

Licensing authorities that have been written to the Highland Council, Dundee City Council, Argyll & Bute Council and Glasgow City Council.

All have amended their policies as a result.
