The Association of Scotland’s Self-Caterers (ASSC) has received confirmation that Scottish Ministers are considering a formal request for an immediate national moratorium on short-term let licensing and planning enforcement affecting existing operators.
This follows a detailed submission issued on our behalf by Burness Paull LLP on 27 November 2025, which sets out significant concerns about the operation of the current regulatory framework and its incompatibility with operators’ rights under the European Convention on Human Rights. The letter explains the escalating economic harm caused by ongoing enforcement activity and highlights the growing risk of substantial compensation claims against public authorities due to the unlawful operation of the scheme. It also urges the Government to pause enforcement to allow time for meaningful engagement on a fair and proportionate reform package that protects both communities and legitimate operators.
In a response issued on 8 December 2025, the Scottish Government confirmed that Ministers are considering the terms of that submission and will provide a full reply in due course.
We welcome the fact that this issue is now under active ministerial consideration. A moratorium would give the Government, industry and other partners the space needed to agree solutions that safeguard responsible businesses, provide clarity for local authorities and secure a regulatory system that is lawful, workable and proportionate.
