The Association of Scotland’s Self-Caterers (ASSC) has issued a formal legal demand to the Scottish Government requesting a moratorium on planning enforcement in relation to existing operators of short term lets, across Scotland. This letter sets out a number of legal arguments, but seeks to work with the Scottish Government on solutions. To allow for an opportunity to work collaboratively with the Government, we will await their response before providing further details. This has been requested within 10 business days, after which we will be able to share further details.
Individual cases are being reviewed in relation to material change-of-use challenges and planning application challenges to Court of Session. We expect to make a decision on next steps and the most suitable cases to pursue next week.
Separately, we are continuing to pursue arguments under Article 1, Protocol 1 of the Human Rights Act, and continue to take legal advice.
